AUCTION TERMS & CONDITIONS
Buyer(s) to enter into a written agreement on the day of the Auction requiring 10% of the purchase price as down payment with the balance due at closing, which will be on or before August 15, 2016. At such time the Seller will provide a title insurance commitment for the exact amount of the purchase price and make provisions to provide and Administrator's Deed. Possession of the farmland is subject to a cash rent lease which expires February 28, 2017. The new buyer will receive the entire cash rent payment for the 2016 crop year. Estimated acres are: Tract One 60 acres, Tract Two 80 acres, Tract Three 80 acres, Tract Four 20.5 acres. The final sale price will be determined by multiplying the highest successful bid by the actual acres which will be determined by a registered land survey. The Seller will pay the 2015 Real Estate Taxes due in 2016, by allowing the Buyer a credit at closing. The Buyer will pay subsequent years real estate taxes. All physical improvements which have been made to this farm are sold "As Is Where Is" without any warranties either implied or expressed. Government payments, if any, will run with the crop and be transferred to the new owner. The sale of this land is not subject to the ability of the Buyers to obtain financing. The Seller reserves the right to confirm the final bid on all four tracts.
